Terms of Service

By downloading, installing, accessing, or using the MyBisayaTutor iOS application (the "App") or the website at mybisayatutor.com (the "Site", and together with the App, the "Service"), you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree, please do not use the Service.

The Service is operated by Namore Studios LLC, a California limited liability company ("Namore Studios", "we", "us", or "our"). These Terms are an agreement between you and Namore Studios LLC.

MyBisayaTutor is an independent educational tool that helps learners acquire Bisaya/Cebuano through the Comprehensible Input approach. As of version 1.1, the Service includes:

• Grammar lessons. 20 lessons across 5 units covering greetings, sentence structure, focus markers, aspect, questions, negation, and more. Each lesson ends with a quiz.
• Vocabulary trainer. A 1,000-word curated Bisaya word bank with spaced-repetition mastery tracking (Don't know → Learning → Mastered).
• Listening practice. Graded audio clips across four difficulty levels (New, Beginner, Intermediate, Advanced) with Cebuano and English transcripts, streamed from a content-delivery network (CDN).
• Short stories. CEFR-tuned reading passages with comprehension questions, streamed from the CDN.
• Native media library. Curated links to publicly available Bisaya videos hosted by third parties (for example, YouTube).
• Built-in translator. Bisaya ↔ English translations routed through a public Google Translate gateway with local query caching for recent phrases.
• Progress engine. Daily-goal ring, streak counter, CEFR progress bar, activity breakdown, and independent-study logging (Pro).
• Local storage only. No accounts, no cloud sync — all progress, preferences, and cached data live on your device.

Features may be added, changed, limited, or removed at any time. The Service is currently available on iOS; other platforms may follow.

The Service is intended for a general audience and is suitable for learners of all ages. If you are under the age of majority where you live, please use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

The App is free to download. The Free tier includes the vocabulary trainer, the translator, the first grammar lesson and quiz, 50 listening clips per level, one reading story per day, one native-media video per day, and preset daily-goal targets.

MyBisayaTutor Pro is a paid subscription that unlocks: all 20 grammar quizzes, unlimited listening, unlimited stories, unlimited native-media video plays, custom daily-goal minutes, streak tracking, the CEFR progress dashboard, independent-study logging, and dark mode.

Pro is sold as auto-renewable subscriptions:

• Monthly Pro — US $2.99 per month (product ID monthlymbt).
• Yearly Pro — US $19.99 per year (product ID annualmbt).

Both products live in the same Apple subscription group (MyBisayaTutorPro). Prices are shown in your local currency at checkout by the App Store and are subject to change; any price change will be communicated in advance by Apple.

Auto-renewal. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID will be charged when the current period ends. You can turn off auto-renew, cancel, or change your subscription any time in Settings → Apple ID → Subscriptions.

Restore Purchases. Signing in with the same Apple ID on a new device and tapping "Restore Purchases" in the App will re-enable Pro on that device.

Refunds. Payments are processed by Apple. All refund requests are handled by Apple under the Apple Media Services Terms and Conditions. We cannot issue refunds directly. To request one, use reportaproblem.apple.com.

Returning subscribers. The paywall inside the App won't auto-open for anyone who has previously subscribed to Pro. You can subscribe again at any time from the Settings screen inside the App.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, and to access the Site for personal, non-commercial language learning.

This license does not include any right to resell, sublicense, redistribute, or commercially exploit the Service or its content.

You should be aware that the Bisaya/Cebuano sentences, English translations, and spoken audio delivered by the App are generated with the assistance of AI tools (including large language models and neural text-to-speech systems). The content is reviewed at a high level by the developer, but:

• AI-generated content may contain errors, unnatural phrasing, or dialectal variation that does not match every regional variety of Cebuano.
• Listening audio is synthesized by AI voices, not recorded by native speakers. For real native voices at real speed, refer to the native media library.
• The Service is a supplementary learning tool. We encourage learners to also engage with native speakers, teachers, and other authoritative resources.
• Results, including any perceived improvement in fluency, vary from person to person and are not guaranteed.

The built-in translator sends the text you enter to a public Google Translate gateway to fetch a translation, and caches recent queries on your device so you can look them up offline. We do not attach your identity to translator queries and we do not store them on our servers. Google's own terms and privacy policy govern the translation service they operate.

The translator is offered as a convenience. Do not rely on it for legal, medical, immigration, safety, or other consequential decisions.

The Service contains links to Bisaya videos and other resources hosted by third parties, including YouTube. We do not host, control, or endorse this third-party content, and we are not responsible for its accuracy, appropriateness, availability, or legality. Third-party content is governed by the terms and privacy policies of the platforms that host it (for example, YouTube's Terms of Service).

Some linked content — for example, Bisaya horror stories or culturally specific media — may not be appropriate for all audiences. Parents and guardians should supervise minors accordingly.

All materials that make up the Service — including but not limited to lesson structure, curated sentence sets, generated audio, translations as arranged, stories, illustrations, logos, page layouts, and the App and Site software — are owned by Namore Studios LLC or its licensors and are protected by copyright, trademark, and other laws. The Cebuano language itself belongs to no one; our rights extend to our particular expression, arrangement, and packaging of learning materials.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, publicly perform, publicly display, mirror, re-upload, sell, or create derivative works based on the Service or its content without our prior written permission.

You may use short quotations from lessons for personal study, non-commercial teaching, or fair-use commentary — please credit "MyBisayaTutor" where practical.

If you believe that content within the App or on the Site infringes your copyright, please email us at [email protected] with (i) a description of the copyrighted work you claim has been infringed, (ii) a description and location of the allegedly infringing material, (iii) your contact information, (iv) a statement made in good faith that the use is not authorized, and (v) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the rights holder.

You agree not to:

• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the limited extent applicable law expressly permits;
• Bulk-download, scrape, mirror, or systematically extract sentences, translations, stories, or audio files from the Service to build a competing product, dataset, or model;
• Use the Service or its content to train, fine-tune, or evaluate any machine-learning model, except with our prior written permission;
• Re-upload App audio, stories, or sentence content to other platforms as if it were your own;
• Circumvent, disable, or otherwise interfere with the free tier's usage limits, the paywall, entitlement checks, or any other technical measure we use to gate paid features;
• Share, resell, or otherwise transfer your Apple ID subscription to another person;
• Use the Service for any unlawful purpose, or in any way that violates the rights of others;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its underlying infrastructure, or any hosting/CDN provider that serves the Service;
• Remove, obscure, or alter any copyright, trademark, or other proprietary notices in the Service.

As an optional way to support ongoing development, we offer a Ko-fi link at ko-fi.com/mybisayatutor. Donations are voluntary gifts, are not purchases, do not create a subscription, and do not unlock Pro features. Pro features are unlocked only through Apple subscriptions.

The Service is provided for educational and self-study purposes only. It is not a substitute for professional language instruction, certification, translation, or interpretation. Do not rely on the Service for legal, medical, immigration, safety, or other decisions where accurate translation or interpretation is critical.

We may add, change, suspend, or discontinue any part of the Service at any time, with or without notice. We may also impose reasonable limits on features or usage to preserve the quality of the Service. If we materially reduce Pro benefits during a paid period, your remedy is to cancel future renewals in Settings → Apple ID → Subscriptions and, if applicable, request a refund from Apple.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR SECURE. WE DO NOT WARRANT THE LINGUISTIC ACCURACY, AUTHENTICITY, OR COMPLETENESS OF ANY AI-GENERATED CONTENT OR ANY THIRD-PARTY CONTENT LINKED FROM THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, MYBISAYATUTOR, ITS FOUNDER, AND ANY CONTRIBUTORS OR CONTENT PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR LEARNING PROGRESS, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50).

You agree to indemnify and hold harmless MyBisayaTutor and its founder from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your misuse of the Service, (ii) your violation of these Terms, or (iii) your violation of any law or the rights of a third party.

These Terms are between you and MyBisayaTutor, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. To the extent you obtained the App through the Apple App Store:

• The license granted above is limited to use of the App on any Apple-branded device that you own or control and as permitted by the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance and support services with respect to the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• We (not Apple) are responsible for addressing any claims by you or any third party relating to the App, including product-liability, legal-compliance, and intellectual-property claims.
• Subscriptions purchased through the App are governed by the Apple Media Services Terms and Conditions in addition to these Terms.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and will have the right to enforce them against you.

You may stop using the Service and uninstall the App at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (for example, Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, and Governing Law) will survive.

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and, for material changes, will provide reasonable notice within the App or on the Site. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. To the extent permitted by law, any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in California, and you consent to their jurisdiction. Nothing in these Terms limits any consumer-protection rights that cannot be waived under the laws of your place of residence.
